29 CFR 1910.23(c)(1): Open sided floor(s) or platform(s) 4 feet or more above the adjacent floor or ground level were not guarded by standard railings (or the equivalent as specified in 29 CFR 1910.23(e)(3)(i) through (v)), on all open sides: (a) Above Office: On or about August 26, 2017, employee(s) were exposed to falls of 9.5 feet to the warehouse floor while storing and handling material located at the storage mezzanine work area which lacked guardrail protection. IN THE ALTERNATIVE 29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: (a) Above Office: On or about August 26, 2017, employee(s) were exposed to falls of 9.5 feet to the warehouse floor while storing and handling material located at the storage mezzanine work area. The employee(s) were not protected by a personal fall arrest system (PFAS) and/or other fall protection device. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date, and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.22(d)(1): In every building or other structure, or part thereof, used for mercantile, business, industrial, or storage purposes, the loads approved by the building official were not marked on plates of approved design which were not supplied and securely affixed by the owner of the building, or his duly authorized agent, in a conspicuous place in each space to which they relate: (a) Above Office: On or about August 26, 2016, the load rating was not provided for a mezzanine storage area that was elevated 9.5 feet above the warehouse floor. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date, and method of abatement, and states employees and their representatives were informed of this abatement.
