29 CFR 1926.20(b)(1): The employer did not initiate and maintain accident prevention programs as necessary to comply with this part:    (a) Action Contractors on or about September 06, 2016, at the address of 8845 OH-66 Defiance, OH: The employer did not have a plan or program to identify job site hazards which assists employees in maintaining a safe working environment.  Such programs would support the employer and employees in identifying and avoiding potential hazards such as falls during job site operations, decreasing the probability of employee injury and/or illness.

29 CFR 1926.501(b)(2)(i): Each employee who was constructing a leading edge 6 feet or more above lower levels was not protected from falling by guardrail systems, safety net systems, or personal fall arrest systems:     a) Action Contractors on or about September 06, 2016, at the address of 8845 OH-66 Defiance, OH: The employer did not ensure employees were protected from falls while installing metal roofing panels atop a wood and steel framed commercial structure.  Employees were exposed to a 20 ft. fall to the ground below while performing work at the leading edge.

29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights), more than six feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes.  a) Action Contractors LLC on or about September 06, 2016, at the address of 8845 OH-66 Defiance, OH: The employer did not to ensure employees were protected from falls through uncovered fiberglass skylight panels while performing leading edge activities atop a low sloped commercial structure. Employees installing metal roof panels atop the structure were exposed to an approximate 25 ft. fall through the uncovered skylights to the interior concrete floor below.
