29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level:    a) Millcreek Mall construction site at 5800 Peach Street in Erie, PA, northwest side of building.  On or about May 16, 2018, the sides of the scaffold were not equipped with guardrails or fall protection.  Employees preforming masonry work were exposed to a 14-foot fall to the ground.

29 CFR 1926.451(h)(2): Where there was a danger of tools, materials, or equipment falling from a scaffold and striking employees below, the employees were not protected in accordance with the provisions of paragraphs (h)(2)(i)-(v):    a) Millcreek Mall construction site at 5800 Peach Street in Erie, PA, northwest side of building.  On or about May 16, 2018, employees working on the ground, below the scaffold, were not protected from falling objects through the use of toeboards, barricades and/or debris nets.

29 CFR 1910.1200(e)(1): Employer did not maintain, at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met (Construction Reference: 1926.59):     a) Millcreek Mall construction site at 5800 Peach Street in Erie, PA, northwest side of building.  On or about May 16, 2018, a copy of the employer's written hazard communication program was not maintained or available at the worksite for the employees working with and around various types of hazardous chemicals and substances including, but not limited to, the MasterPel 240MA mortar additive and Federal White Masonry Concrete which contains Portland cement.

On or about May 16, 2018, Safety Data Sheet for the Federal White Masonry Cement was not maintained at the worksite.  The SDS was not readily available for employees working with the mortar which contains Portland cement.

On or about May 16, 2018, employees were working around and with chemicals that included but not were not limited to, MasterPel 240MA mortar additive and Federal White Masonry Concrete which contains Portland cement.  Employees had not been trained on the hazards of the chemicals and materials they are exposed to in their work area.
