29 CFR 1926.451(b)(2):   Scaffold platforms and walkways were not at least 18 inches wide:  a)  130 Park Avenue, Florham Park, NJ.  Worker was exposed to 11 to 12 foot falls to the ground below as the platform and walkway on the fabricated frame scaffold erected around the column was not at least 18 inches  wide on 3 of its 4 sides as only one plank was used on the 3 sides.                                        Violation observed on or about 09/13/2016.

29 CFR 1926.451(g)(1)(vii):   Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above a lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section:   a)  130 Park Avenue, Florham Park, NJ.  Worker was exposed to 11 to 12 foot falls to the ground below from the platform of the fabricated frame scaffold as a guardrail system was missing its midrail and this masonry-type scaffold had it's end frames' openings not guarded.                                      Violation observed on or about 09/13/2016.

29 CFR 1926.502(d)(16)(iii):   Personal fall arrest systems, when stopping a fall, were not rigged such that an employee could not free fall more than 6 feet (1.8 m) nor contact any lower level:  a)  130 Park Avenue, Florham Park, NJ.  Worker was exposed to 11 to 12 foot falls to the ground below from the platform of the fabricated frame scaffold as when his lanyard was anchored to the scaffold's end frame, the worker's fall protection system was rigged such that he could fall 18. 5 feet meaning that he would hit the ground before his fall protection system could work.                                      Violation observed on or about 09/13/2016.  b)  130 Park Avenue, Florham Park, NJ.  Workers were exposed to 16 foot falls to the ground below from the top of the columns as with their lanyards anchored to the rebar at the top of the forms, the workers' fall protection systems were rigged such that they could fall 18.5 feet meaning that they would hit the ground before their fall protection systems  could work.                                        Violation observed on or about 09/09/2016.

29 CFR 1926.451(c)(2):   Supported scaffold poles, legs, posts, frames,  or uprights did not bear on base plates, mud sills or other adequate firm foundation:   a)  130 Park Avenue, Florham Park, NJ.  The scaffold's uprights did not have base plates  but were resting directly on the ground which could result in scaffold instability and worker injuries.                                        Violation observed on or about 09/13/2016.   Conserv Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 314682170, citation number 1, item number 1, and was affirmed as a final order on or about 04/20/2012, with respect to a workplace located at 447 Belmont Avenue (Walgreens), Haledon, NJ.
