29 CFR 1910.132(d)(1): The employer shall assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). If such hazards are present, or likely to be present, the employer shall:  a) At the establishment, employees wore leather boots, and cotton pants and shirts when cleaning the tanks of tanker trucks, confined spaces, containing oil and gas industry waste. The employer had not conducted an adequate workplace hazard assessment to determine the hazards of the employee's job tasks.

29 CFR 1910.132(d)(1)(i): Select, and have each affected employee use, the types of PPE that will protect the affected employee from the hazards identified in the hazard assessment;  a) At the establishment, employees were exposed to the hazard of falls when working on the tops of tanker trucks, and when entering tanker truck tanks through man-way hatches located on the top of the tanks. The top of the tanks were as much as eight feet above the ground exposing the employees to fall hazards. The employer had not selected and provided fall protection.

29 CFR 1910.146(d)(5)(i): Test conditions in the permit space to determine if acceptable entry conditions exist before entry is authorized to begin, except that, if isolation of the space is infeasible because the space is large or is part of a continuous system (such as a sewer), pre-entry testing shall be performed to the extent feasible before entry is authorized and, if entry is authorized, entry conditions shall be continuously monitored in the areas where authorized entrants are working;  a) On or about September 15, 2016, the two owner/operators of E & R Energy Services, LLC, performing tank cleaning work were rescued from inside the tanks of a tanker truck by the local fire department when the two employees became unresponsive due to a hazardous atmosphere inside the confined space. The employer had not ensured that testing of the atmosphere inside the tanker truck's tanks had been completed prior to authorizing entry to perform tank cleaning activities.

29 CFR 1910.146(d)(6): Provide at least one attendant outside the permit space into which entry is authorized for the duration of entry operations;   a) On or about September 15, 2016, the two owner/operators of E & R Energy Services, LLC, performing tank cleaning work were rescued from a tanker truck by the local fire department when the two employees became unresponsive due to a hazardous atmosphere inside the confined space. The employer had not enforced that at least one of the employees perform the attendant's responsibilities and remain outside the confined space before and during the periods in which the authorized employee was inside the confined space.

29 CFR 1910.146(e)(1): Before entry is authorized, the employer shall document the completion of measures required by paragraph (d)(3) of this section by preparing an entry permit.   a) On or about September 15, 2016, the two owner/operators of E & R Energy Services, LLC, performing tank cleaning work were rescued from a tanker truck by the local fire department when the two employees became unresponsive due to a hazardous atmosphere inside the confined space. The employer had not ensured that an entry permit that included the items in 29 CFR 1910.146(d)(3) through 29 CFR 1910.146(d)(14) had been completed and signed prior to entry into the confined space.

29 CFR 1910.146(k)(1)(v): Provide the rescue team or service selected with access to all permit spaces from which rescue may be necessary so that the rescue service can develop appropriate rescue plans and practice rescue operations.   a) On or about September 15, 2016, the two owner/operators of E & R Energy Services, LLC, performing tank cleaning work were rescued from a tanker truck by the local fire department when the two employees became unresponsive due to a hazardous atmosphere inside the confined space. The company had not provided the fire department with access to its facility's confined spaces prior to the incident.
