29 CFR 1926.451(e)(9)(i):   The employer did not provide safe means of access for each employee erecting or dismantling a scaffold:  a)  Martin Luther King Building & U.S. Courthouse, 50 Walnut Street, Newark, NJ.  Employees erecting the scaffold six tiers up and those hoisting up materials from the scaffold canopy were not provided a safe means of scaffold access using ladders or stairway-type access or even scaffold frames which are proper for climbing.                                        Violation observed on 08/29/2016.

29 CFR 1926.451(g)(1)(vii):   Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section:  a)  Martin Luther King Building & U.S. Courthouse, 50 Walnut Street, Newark, NJ.  Employees were exposed to falls of 13'4" to the ground below from the entrance canopy scaffold as no methods of fall protection were in use while the workers were hoisting up scaffold frames to workers erecting the top section of scaffolding.                                      Violation observed on 08/29/2016.

29 CFR 1926.451(g)(2):   The employer did not provide fall protection for employees erecting or dismantling supported scaffolds:  a)  Martin Luther King Building & U.S. Courthouse, 50 Walnut Street, Newark, NJ.  Employees were exposed to falls of up to 49 feet to the ground below from the tubular welded frame scaffold as no methods of fall protection were in use while the workers were erecting the scaffolding and at a location where fall protection methods would be feasible.                                      Violation observed on 08/29/2016.

29 CFR 1926.454(a):   The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.   a)  Martin Luther King Building & U.S. Courthouse, 50 Walnut Street, Newark, NJ and at the Corporate Offices at 2511 3rd Avenue, Bronx, New York.  Employee performing scaffold erection had not been trained by the employer in the subject matter of scaffold erection and how to recognize and minimize the hazards associated with this type of activity.                                        Violation observed on 08/29/2016.
