29 CFR 1910.178(l)(4)(i): 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance shall be conducted at least once every three years:   On or about September 21, 2016, and at time prior thereto, at this at dairy products distribution warehouse, employees were involved in loading and unloading heavy pallets with food products and were utilized powered industrial trucks (PITs). The employer did not evaluate his powered industrial trucks operator's performance at least once every three years for such, but not limited to:   a) Toyota Electric Fork Lift Truck ; b) Three Yale Electric Pallet Jack Lift Trucks; c) Crown Electric Fork Lift Truck; d) Yale Electric Fork Lift Truck; and,  e) Two Crown Electric Clamp Trucks.

29 CFR 1910.178(q)(7): Industrial trucks were not examined before being placed in service:  On or about September 21, 2016, and at time prior thereto, at this at dairy products distribution warehouse, employees were involved in loading and unloading heavy pallets with food products and were utilized powered industrial trucks (PITs) without performing any daily examination of the truck conditions before each shift, such as, but not limited to:   a) Toyota Electric Fork Lift Truck; b) Three Yale Electric Pallet Jack Lift Trucks; c) Crown Electric Fork Lift Truck; d) Yale Electric Fork Lift Truck; and,  e) Two Crown Electric Clamp Trucks.

29 CFR 1910.132(d)(2): The employer did not verify that the required workplace hazard assessment has been performed through a written certification which included the requirements as outlined in 29 CFR 1910.132(d)(2):   On or about September 21, 2016, and times prior thereto, at this establishment, employees  were exposed to hazards such as, but not limited to, falling dairy products, caught-in-between hazards and chemical exposure; the employer had not verified through a written certificate that a hazard assessment was performed.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:   On or about September 21, 2016, and times prior thereto, at this at dairy products distribution warehouse, employees involved in distribution dairy products,  and were exposed to chemicals, such as, but not limited to, and using disinfectants and powered industrial trucks electrical batteries chemicals.  The employer had not developed his Hazard Communication program which would address labeling and other forms of warning on chemicals containers, Safety Data Sheets and employees' information and training on the hazards associated with chemicals used at this site.  The written program must also contain the following:  a.    a list of all hazardous chemicals on site; b.    the methods the employer will use to inform employees of the hazards associated with non-routine tasks involving          chemicals, such as a spill; c.    the hazards of chemicals contained in piping that is not labeled; and, d.    the method the employer will use to inform other employers (contractors) of the chemicals their employees might        be exposed to while performing duties at this site.
