29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc. a. On or about September 23, 2016 and at times prior, employees were operating a hydraulic rotary pipe bender manufactured by Pines Engineering, Picoma Bender 6, Serial 11630-11015, to form metal conduit pipe. Employees would enter into the hazardous area of the machine to position the pipe, hold the pipe by hand while the bender completed the cycle, and remove the pipe from the machine. An unguarded point of operation and pinch point area between the rotating clamp arm and the machine exposed employees to a crushed by hazard.

29 CFR 1910.147(c)(4)(ii): The procedures shall clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, the following: a. On or about September 23, 2016 and at times prior, the employer's energy control procedure for the hydraulic rotary pipe bender manufactured by Pines Engineering, Picoma Bender 6, Serial 11630-11015, did not contain adequate information to include, but not limited to, the following: (1) A specific statement of the intended use of the procedure pursuant to 1910.147(c)(4)(ii)[A]. The procedure did not include a statement to inform employees of the intended use of the procedure. (2) Specific procedural steps for shutting down, isolating, blocking and securing machines or equipment to control hazardous energy pursuant to 1910.147(c)(4)(ii)[B]. The procedure did not include methods for shutting down, isolating, and controlling the hydraulic hazardous energy source. (3) Specific requirements for testing a machine or equipment to determine and verify the effectiveness of lockout devices, tagout devices, and other energy control measures 1910.147(c)(4)(ii)[D]. The procedure lacked specific steps to verify that isolation and deenergization of the hydraulic energy source was accomplished.
