29 CFR 1926.1101(k)(2)(i): Before work subject to this standard began, the building and/or facility owner(s) did not determine the presence, location and quantity of asbestos containing material (ACM) and/or presumed asbestos containing material (PACM) at the worksite pursuant to 29 CFR 1926.1101(k)(1). a) On or about 8/11/2016, contractor employees working on the remodel project at 5202 Desert Storm on Fort Campbell, KY, and were not informed, by the building owner, of the presence, location and quantity of asbestos containing material (ACM) and/or presumed asbestos containing material (PACM) at the worksite. Exposure to asbestos could lead to various lung diseases and cancer. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.1101(k)(2)(ii)(A): Building and/or facility owners failed to notify prospective employers applying for or bidding for work whose employees can reasonably be expected to work in or adjacent to areas containing asbestos containing material or presumed asbestos containing material of the presence, location and quantity. a) On or about 8/11/2016, contractor employees working on the remodel project at 5202 Desert Storm on Fort Campbell, KY, and were not informed by the building owner of asbestos containing materials in the work areas. Exposure to asbestos could lead to various lung diseases and cancer.
