29 CFR 1926.554(a)(6): All overhead hoists in use did not meet the applicable requirements for construction, design, installation, testing, inspection, maintenance, and operation, as prescribed by the manufacturer.  a) At the construction site located at Campo Felice, on or about 09/27/2016 an employee was working inside the HVAC tightening clams inside of the shaft on the 15th floor, while OZ Builder's Hoist was being operated above with a load, pipes were being put inside the chase/basket from the 23rd floor resulting in a pipe shifting out of the basket and striking the employee on the 15th floor. As per the operations manual for the OZ Builder's Hoist 500 Pounds, pg. #12 "Warnings; Not Adhering to the following warnings may result in personal injury or equipment damage.; and, 3. Do not work, walk, or stand under an operating hoist.
