29 CFR 1926.601(b)(4): The employer had in use motor vehicle equipment having an obstructed view to the rear which did not have a reverse signal alarm audible above the surrounding noise level or an observer signaling it was safe to back up the vehicle. a) 80 Monrovia Ave, Smyrna DE - On or about September 22, 2016 the employer failed to ensure that while operating a Case 95XT Skid Steer Loader with an obstructed view to the rear; the equipment was either equipped with a reverse signal alarm distinguishable from the surrounding noise level or that an employee signaled that it was safe to do so. While moving in the reverse direction, the loader ran over and crushed an employee's leg.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a) Larimore Construction, Inc. - On or about September 22, 2016, the employer failed to ensure that all employees were instructed in the recognition and avoidance of unsafe conditions in their environment to control or eliminate any hazards, in that employees operating a Case 95XT Skid Steer Loader were not trained in the proper and safe operation of the equipment, to include but not limited to operating the equipment with an obstructed view in the rear of the cab.
