29 CFR 1926.20(b)(2):  The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of job-sites, materials, and equipment to be made by a competent person:   (a)  Nico Construction, 7160 E. Oxford Avenue, Denver, CO:  On or about September 28th, 2016, the employer did not ensure a "competent" person made frequent inspections of the job-site to ensure the use of fall protection while employees removed wood shake shingles. Two employees were observed tearing off wood shake shingles on a 7/12 slope single story residence without Personal Fall Arrest Systems (PFAS).  This condition exposed employees to a fall hazard of approximately 9 feet to the ground below.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest system.   (a)  Nico Construction, 7160 E. Oxford Avenue, Denver, CO:  The employer did not provide and ensure the use of fall protection while employees removed damaged wood shake shingles from a 7/12 slope single story roof.  As a result, employees were exposed to a fall hazard of approximately 9 feet to the ground below.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards. The program did not enable each employee to recognize the hazards of falling and train each employee in the procedures to be followed in order to minimize these hazards:  (a)  Nico Construction, 7160 E. Oxford Avenue, Denver, CO:  The employer did not ensure fall protection training was provided by a "competent person" prior to permitting employees to remove damaged wood shake shingles from a single story 7/12 slope roof.  As a result, employees were exposed to a fall hazard of approximately 9 feet to the ground below.
