29 CFR 1910.146(c)(5)(ii)(C): Employees entered into permit spaces that met the conditions set forth in 29 CFR 1910.146(c)(5)(i) but before an employee entered the space, the internal atmosphere was not tested with a calibrated direct-reading instrument: The employer is failing to protect employees from atmospheric hazards associated with entering confined spaces. This was most recent occurrence of this was evident during the inspection of the facility located at 71634 Road 380, McCook, NE, where the employer has employees entering multiple boot pits without filling out an entry permit based on the inadequate air quality testing they are performing. Instances include but are not limited to: i. Employees lowering the RKI GX-2009 Portable Gas Monitor into the sublevel below the bins approximately 7-8 feet so that the meter was a few inches off the ground to take a measurement; they then lift the meter up and read it as an accurate measurement of the air quality inside the tunnel. The meter is a direct read device that measures the air around it at the time it is taking the reading. ii. Employees lowering the RKI GX-2009 Portable Gas Monitor approximately 7-8 feet so that the meter was a few inches off the ground to take a measurement into the boot pit located at the far east end of the sublevel below the bins; they then lift the meter up and read it as an accurate measurement of the air quality inside the tunnel. The meter is a direct read device that measures the air around it at the time it is taking the reading. iii. Employees are raising the meter back up based on hearing a beep sound, manual for device does not identify with any sounds after measurement is complete; the only sounds the device makes indicate air contaminants in the area. iv. Employees are only taking one measurement at the lowest level failing to monitor the atmosphere for layered contaminants.
