29 CFR 1926.502(a)(2): The employer did not provide and install all fall protection systems required by this subpart for employee(s) and did not comply with all other pertinent requirements of this subpart before employee(s) began the work that necessitates the fall protection. On or about 6 October 2016, an employee used the fall protection system installed to perform tuck-point work on the ledge of a parapet wall without the employer determining the anchorage for such system to be capable of supporting at least 5,000 pounds per employee attached, exposing the employee to a fall hazard of approximately 150 feet to the concrete below.

29 CFR 1926.502(d)(16)(iii): Personal fall arrest systems, when stopping a fall, were not rigged such that an employee could not free fall more than 6 feet (1.8 m) nor contact any lower level. On or about 6 October 2016, an employee performing tuck-point work was doing so at a height of approximately 150 feet on the ledge of a parapet wall with his personal fall arrest system attached to a fiber rope by a rope grab that was at his feet, allowing for a free fall of more than 6 feet and a pendulum effect, exposing the employee to the hazard of striking the wall below the parapet or swinging into the aerial lift nearby.
