29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  a- Block 14802, Lot 89, 6 Mimosa Court, Sicklerville NJ: On or about 10/06/16 a worksite company employee was exposed to fall hazards when utilizing an aluminum extension ladder whose side rails did not extend at least three feet above the active walking/working surface of the structure's porch roof. Condition noted on or about 10/06/16.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.1053(b)(5)(i): Non-self-supporting ladders were not used at an angle such than the horizontal distance from the top support to the foot of the ladder way approximately one-quarter of the working length of the ladder (the distance along the ladder between the foot and the top support):  a- Left Side of House, Block 14802, Lot 89, 6 Mimosa Court, Sicklerville NJ: On or about 10/06/16 worksite company employees were exposed to fall hazards when utilizing an aluminum extension ladders whose rise to run ratio was not 4 to 1 and, as such, was not having an angle of approximately 75 degrees from the horizontal .  Condition observed on or about 10/06/16.  b- Accessing Porch Roof, Block 14802, Lot 89, 6 Mimosa Court, Sicklerville NJ: On or about 10/06/16 worksite company employees were exposed to fall hazards when utilizing an aluminum extension ladders whose rise to run ratio was not 4 to 1 and, as such, was not having an angle of approximately 75 degrees from the horizontal. 29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  Each employee engaged in the cutting and nailing of plywood sheathing is not protected by using eye/face protection.  New Homes Construction, Inc. does not ensure the use of eye/face protection while cutting and nailing sheathing.  This violation was most recently observed at Block 14802, Lot 89, 6 Mimosa Court, Sicklerville NJ where an employee, not wearing any eye/face protection, was exposed to struck by hazards when using an pneumatic nailer and electric circular saw at the worksite.  This condition was observed on or about 10/06/16.  To abate this violation the employer must ensure that its employees performing cutting, nailing and other related activities, are protected from eye/face injuries and that no employee is allowed to be exposed to eye/face injuries without using the proper eye/face protective equipment.  New Homes Construction, Inc. was previously cited for a Repeat violation of this Occupational Safety & Health Standard or its equivalent standard, 29 CFR 1926.102(a)(1), which was contained in OSHA Inspection Number 1040582, Citation Number 2, Item Number 2 and was confirmed as a final order on 05/31/16, with respect to a workplace located at 12 Montclaire Road, Lot 19, Medford NJ. 29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   Each employee engaged in sheathing activities with unprotected sides and edges, is not protected from falling by the use of fall protection system(s).  New Homes Construction, Inc. does not ensure the use of fall protection while doing sheathing work.  This violation was most recently observed at Block 14802, Lot 89, 6 Mimosa Court, Sicklerville NJ where employees were exposed to fall hazards, in excess of 11 feet to the ground surface below, when walking/working from pitched roofs of a residential structure without the use of any fall protection.  This condition was noted on or about 10/06/16.  To abate this violation the employer must ensure that its employees performing sheathing installation, and other related activities, are protected from falls and that no employee is allowed to be exposed to a fall hazard of 6 feet or more without the use of adequate fall protection.   Pursuant to 29 CFR 1903.19, New Homes Construction, Inc. must submit documents describing the steps it is taking to ensure compliance, including a description of how these steps protect its employees from fall hazards.   New Homes Construction, Inc. was previously cited for a Repeat violation of this Occupational Safety & Health Standard or its equivalent standard, 29 CFR 1926.501(b)(13), which was contained in OSHA Inspection Number 1040582, Citation Number 2, Item Number 1 and was confirmed as a final order on 05/31/16, with respect to a workplace located at 12 Montclaire Road, Lot 19, Medford NJ.    New Homes Construction, Inc. was previously cited for a Repeat violation of this Occupational Safety & Health Standard or its equivalent standard, 29 CFR 1926.501(b)(13), which was contained in OSHA Inspection Number 638798, Citation Number 2, Item Number 1 and was confirmed as a final order on 05/13/13, with respect to a workplace located at 16 Westbury Drive, Winslow NJ.

This violation was most recently observed at Block 14802, Lot 89, 6 Mimosa Court, Sicklerville NJ where employees were exposed to fall hazards when utilizing two separate aluminum extension ladders that were both missing their factory supplied feet, contained visibly damaged rungs, etc.  This condition was noted on or about 10/06/16. To abate this violation the employer must ensure that its employees, using portable ladders, are protected from falls and that no employee is allowed to use portable ladders with structural defects.   New Homes Construction, Inc. was previously cited for a Serious violation of this Occupational Safety & Health Standard or its equivalent standard, 29 CFR 1926.1053(b)(16), which was contained in OSHA Inspection Number 1040582, Citation Number 1, Item Number 4 and was confirmed as a final order on 05/31/16, with respect to a workplace located at 12 Montclaire Road, Lot 19, Medford NJ. 29 CFR 1926.1060(a): The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would enable each employee to recognize hazards related to ladders and stairways and train each employee in the procedures to be followed to minimize these hazards:  Each employee using portable ladders is not protected from falling in that they are not trained to recognize the hazards and know the procedures to be followed to minimize these hazards.  New Homes Construction, Inc. does not ensure that each employee has been trained to recognize and minimize hazards associated with the use of ladders.  This violation was most recently observed at Block 14802, Lot 89, 6 Mimosa Court, Sicklerville NJ where worksite company employees were exposed to fall hazards when utilizing two separate aluminum extension ladders that contained missing feet, visibly damaged rungs, etc.  At the time of the worksite inspection, these employees had not received any ladder hazard recognition training or training on procedures to be followed to minimize these hazards from the company. This condition was noted on or about 10/06/16.  To abate this violation the company must ensure that all of their employees have been trained so that they can recognize hazards related to ladders and stairways and that each of these employees know and follow procedures to minimize these hazards.   New Homes Construction, Inc. was previously cited for a Serious violation of this Occupational Safety & Health Standard or its equivalent standard, 29 CFR 1926.1060(a), which was contained in OSHA Inspection Number 1040582, Citation Number 1, Item Number 5 and was confirmed as a final order on 05/31/16, with respect to a workplace located at 12 Montclaire Road, Lot 19, Medford NJ.
