29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.  a)  At 7936 Oak Crest Place, Montgomery, Alabama:  On or about October 11, 2016 and at times prior:  the employer allowed his employees to use the scaffold side as a ladder to gain access to the work platform and the sides of the scaffold are not designed to be used as a ladder exposing his employee to a fall hazard of 13 feet 7 inches to the ground below.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:  a)  At 7936 Oak Crest Place (Middle Scaffold)  Montgomery, Alabama:  On or about October 11, 2016 and at times prior:  the employer allowed his employees to work from a job made scaffold located on a roof top without fall protection exposing his employee to a fall hazard of 10 feet 3 inches to the ground below.  b)  At 7936 Oak Crest Place (Left Scaffold)  Montgomery, Alabama:  On or about October 11, 2016 and at times prior:  the employer allowed his employees to work from a two buck high scaffold  without fall protection exposing his employee to a fall hazard of 13 feet 7 inches to the ground below.  c)  At 7936 Oak Crest Place (Right Scaffold)  Montgomery, Alabama:  On or about October 11, 2016 and at times prior:  the employer allowed his employees to work from a two buck high scaffold  without fall protection exposing his employee to a fall hazard of 13 feet 7 inches to the ground below.
