29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used: a) At 7826 Ebury St, Montgomery, Alabama: On or about February 8, 2017 and at times prior: the employer allowed his employees to use the scaffold side as a ladder to gain access to the work platform and the sides of the scaffold are not designed to be used as a ladder exposing his employee to a fall hazard of 13 feet 1 inch to the ground below. THE BARRIENTOS CONSTRUCTION, LLC., WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.451(E)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1182917 CITATION NUMBER 1, ITEM NUMBER 1, AND WAS AFFIRMED AS A FINAL ORDER ON NOVEMBER 15, 2016, WITH RESPECT TO A WORKPLACE LOCATED AT 7936 OAK CREST PLACE, MONTGOMERY, ALABAMA.
