29 CFR 1910.146(c)(5)(ii)(H): Employees entered into permit spaces that met the conditions set forth in 29 CFR 1910.146(c)(5)(i), but the employer did not verify through a written certification that the space was safe for entry and that the measures required by 29 CFR 1910.146(c)(5)(ii) have been taken:    On or about October 11, 2016, and at times prior to and thereafter, the employer did not verify the milk tanks were safe for entry for employees to perform welding and grinding operations in that they did not complete a written certification documenting the following:    a) Prior to entry, the atmospheric testing of the internal atmosphere for oxygen content, flammable gasses and vapors and any potential toxic air contaminants.    b) The forced air ventilation has eliminated any hazardous atmosphere.    c) The forced air ventilation is directed to ventilate the immediate areas where an employees is present.    d) The air supply for the forced air ventilation is from a clean source and does not increase the hazards in the space.    e) The atmosphere within the space is periodically tested as necessary to ensure the forced air ventilation  is preventing the accumulation of a hazardous atmosphere.

29 CFR 1910.1026(l)(1)(iii): The employer had not included chromium (VI) in the hazard communication program, established to comply with the Hazard Communication Standard, 29 CFR 1910.1200, ensured that each employee had access to labels on containers of chromium (VI) and to safety data sheets, and was trained in accordance with the requirements of the Hazard Communication Standard and 29 CFR 1910.1026(l)(2), including the contents of the Hexavalent Chromium Standard, the purpose and a description of the medical surveillance program, and made copies of this standard available to all affected employees:    On or about October 11, 2016, and at times prior to and thereafter, the employer did not include chromium (VI) in the hazard communication program, including but not limited to, the health hazards of chromium (VI).
