29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i): On or about October 12, 2016, during the construction of a sanitary sewer line at approximately 9650 Lake Avenue, Cleveland, Ohio, the employer did not ensure an employee working inside a trench, at a depth of approximately 7 feet and with near 90 degree vertical walls, was protected from cave-ins by an adequately designed protection system. The soil was classified as; Cohesive Soil, type B.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: On or about October 12, 2016, during the construction of a sanitary sewer line at approximately 9509 Lake Avenue, Cleveland, Ohio, the employer did not ensure a stairway, ramp, ladder or other safe means of egress was located inside an approximately 7 foot deep by 13 foot long trench with near 90 degree vertical walls.
