OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to caught-in hazards when working in a permit required confined space. On or about September 21, 2016 at House #2, the employer permitted employees to enter the manure pit to perform cleaning, servicing and maintenance on the belt of an energized conveyor system. Employees were exposed to being caught in the conveyor belt as it traveled the length of the manure pit. On or about October 20, 2016 at House #2, the employer permitted employees to enter the manure pit to perform cleaning, servicing and maintenance on the belt of an energized conveyor system. Employees were exposed to being caught in the conveyor belt as it traveled the length of the manure pit.

29 CFR 1928.57(a)(11): Where a moving machinery part presented a hazard during servicing or maintenance, the engine was not stopped, the power source was not disconnected, and all machine movement was not stopped before servicing or maintenance was performed, except where the Employer could establish the following in 1928.57(a)(11)(i-iii): On or about September 21, 2016, employees performing service and maintenance on the Manure Drying System (MDS) Conveyor System were exposed to caught-in and amputation hazards, because the employer did not ensure, the equipment was properly locked out and stopped before tracking the belt.
