29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): On or about March 12, 2019, employees performed work activities and used powered industrial trucks at the worksite. Prior to allowing employees to use the equipment, the employer did not ensure that each operator had completed training that included all of the truck and workplace related topics listed in the standard and completed an evaluation of the operator's performance through practical exercises.

29 CFR 1910.178(l)(6): The certification did not include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation: On or about March 12, 2019 the employer did not document the required powered industrial truck training and evaluation for each operator. There was no written documentation that included the operator's name, date of the training, date of the evaluation and/or the name of the person conducting the evaluation. Each operator who had received training at a previous employer had not been evaluated and certified prior to them operating a power industrial truck and the employer did not re-certify employees, documenting the operator's name, date of the training, date of the current evaluation, and the name of the person conducting the evaluation.
