29 CFR 1926.20(b)(1): The employer did not initiate and maintain a safety program which included the OSH standards which would protect their employees from working conditions which were unsanitary, hazardous or dangerous to the employees' health or safety:  a- 2030 Old Trenton Road, West Windsor NJ: The employer did not maintain a safety program on site to insure that workers were protected from hazardous conditions that would reasonably be encountered while engaged in performing painting, interior stud installation, site clean up and other related activities at the worksite.  Condition noted on or about 10/18/16.  NOTE: IN ADDITION TO ABATEMENT DOCUMENTATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM.  FAILURE TO DO SO WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 AS PER 29 CFR 1903.19.

29 CFR 1926.150(c)(1)(vi): A fire extinguisher, rated not less than 10B, was not provided within 50 feet of wherever more than 5 gallons of flammable or combustible liquids or 5 pounds of flammable gas were being used on the jobsite:  a- Inside of Building, 2030 Old Trenton Road, West Windsor NJ: Company employees were exposed to fire hazards when a portable fire extinguisher was not available at the worksite when more than 5 gallons of flammable liquids were being used.   Condition observed on or about 10/18/16.  NOTE: IN ADDITION TO ABATEMENT DOCUMENTATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM.  FAILURE TO DO SO WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 AS PER 29 CFR 1903.19.

29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:  a- Front of Building Facing Old Trenton Road, 2030 Old Trenton Road, West Windsor NJ: A company employee was exposed to fall hazards when working from an elevated man lift basket of an articulated boom lift.  This employee was not wearing a full body harness, with lanyard attached, at the time of the exposure.   Condition observed on or about 10/18/16.
