OSH ACT of 1970 Section (5)(a)(1): Public Law 91-596, the Occupational Safety and Health Act of 1970, Section 5(a)(1): The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or are likely to cause death or serious physical harm to his employees, in that employees were exposed to struck-by hazards. a. On or about November 15, 2016 the employer failed to keep the workplace free of a hazard to which employees of that employer were exposed: Employees were exposed to struck-by hazards while lifting ­­­­metal plates, with custom designed under hook devices. The employer had not taken any measures to determine or communicate the safe working loads of the devices. This misinformation could allow employees to overload the devices and drop the load.
