29 CFR 1926.502(i)(3): All covers shall be secured when installed so as to prevent accidental displacement by the wind, equipment, or employees. a. On the roof where employees were sealing drywall inside where the HVAC systems will be located, the plywood cover over the vent was not secured from displacement thereby exposing employees to a fall hazard. On October 19, 2016 an employee stepped onto the plywood when not secured and the employee fell four floors into the duct work severely injuring the employee.

29 CFR 1926.502(i)(4): All covers shall be color coded or they shall be marked with the word "HOLE" or "COVER" to provide warning of the hazard. a. On the roof where employees were applying a sound barrier sealant, the cover laying on the hole was not marked with the word "HOLE" to warn employees of a potential fall hazard thereby exposing employees to a four story fall hazard.

29 CFR 1926.503(c): "Retraining." When the employer has reason to believe that any affected employee who has already been trained does not have the understanding and skill required by paragraph (a) of this section, the employer shall retrain each such employee. Circumstances where retraining is required include, but are not limited to, situations where: a. On the roof where employees were sealing the drywall cracks for sound proofing, the employees did not understand the requirements of the fall protection standard in relationship to covering and protecting employees from holes thereby exposing employees to a fall hazard.
