29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) Worksite at 4102 Bergen Turnpike, North Bergen, NJ 1) A worker on the 18 oz line was exposed to continuous noise levels at 69.9% of the permissible daily noise exposure (8 hour Time Weighted Average sound level of 90 dBA) which is 0.7 times the allowable exposure limit. The Action Level is 85 dBA. The equivalent sound level of the measured dose is 87.4 dBA. Sampling was performed for 396 minutes on 1/25/17, with the unsamped portion of time considered to represent zero exposure. 2) One grater was exposed to continuous noise levels at 78.8% of the permissible daily noise exposure (8 hour Time Weighted Average sound level of 90 dBA) which is 0.9 times the allowable exposure limit. The Action Level is 85 dBA. The equivalent sound level of the measured dose is 88.2 dBA. Sampling was performed for 405 minutes on 1/25/17, with the unsamped portion of time considered to represent zero exposure. 3) A second grater was exposed to continuous noise levels at 91.7% of the permissible daily noise exposure (8 hour Time Weighted Average sound level of 90 dBA) which is 0.9 times the allowable exposure limit. The Action Level is 85 dBA. The equivalent sound level of the measured dose is 89.3 dBA. Sampling was performed for 410 minutes on 1/25/17, with the unsamped portion of time considered to represent zero exposure. Violation occurred on or about 1/25/17.

The Action Level is 85 dBA. The equivalent sound level of the measured dose is 87.4 dBA.
