OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. (a) In Building 400 near the base of the ladder, on or about and at times preceding to October 17, 2016, concrete bolts were protruding 3 inches above the walking surface, exposing workers to tripping hazards.

29 CFR 1926.1060(a)(1): The employer did not provide a training program for each employee using ladders as necessary, enabling each employee to recognize hazards related to ladders and the procedures to be followed to minimize these hazards: (a) In Building #400 at the job-made ladder, on or about and at times preceding to October 17, 2016, employees had not been trained on ladder safety, including information about the importance of facing the ladder and maintaining 3-point contact when ascending or descending the ladder.
