Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a) Select Industries, 420 S. Cascade Street, New Castle, PA. On or about October 19, 2016, and times prior thereto, the operator protection device (seatbelt) was not used by the operators when operating the Clark forklift. The operator protection device was intended to reduce the risk of entrapment of the operator in the event of a tip-over. Employees operated the forklift for activities including, but not limited to, transporting pallets of the lithographed plates.
