29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section: On the south side of the construction site, an employee installing framing material from a basket elevated by a 8042 JLG forklift without fall protection was exposed to a fall hazard of approximately 10 feet to the ground below.

29 CFR 1926.602(c)(1)(vi): Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks. On the south side of the construction site, the employer allowed the forklift with the forks elevated to be unattended while installing framing material on a commercial building.
