29 CFR 1926.454(a)(3): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the proper use of the scaffold, and the proper handling of materials on the scaffold.   a)  The Bailey Building - On or about 10/20/16, the employer did not have each employee trained to recognize hazards associated with performing work from a fabricated frame scaffold.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  a)  The Bailey Building - On or about 10/20/16, Employee(s) were utilizing an 8-foot portable stepladder to access the 6-foot high surface of a fabricated frame scaffold.  The ladder did not extend at least 3 feet past the landing and was not provided with a grab rail exposing employees to fall hazards.  Saeteros Construction, LLC was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1094041, citation number 1, item number 3, and was affirmed as a final order on 5/16/16, with respect to a workplace located at1111 S State St, Ephrata, PA.
