OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that workers are exposed to injuries from utilizing an unauthorized and unapproved attachment to a mobile gantry crane. On or about 22 October 2016, and at times prior thereto, workers would utilize a ladder platform attachment to a Mi-Jack MJ50 Travelift mobile gantry crane without the attachment being authorized or approved by the manufacturer or certified by an engineer, exposing the workers to a struck by or crushing hazard from the attachment falling off the crane.

29 CFR 1910.23(a)(2): Ladderway floor opening(s) or platform(s) were not guarded by a standard railing with standard toeboard(s) on all exposed sides (except at the entrance to opening) with passage through the railing either provided with a swinging gate or so offset that a person could walk directly into the opening. On or about 22 October 2016, and at times prior thereto, workers on an elevated platform did not utilize a means of fall protection at the ladder opening, exposing the two workers to a fall hazard of approximately 13 feet 9 inches to the ground below.

On or about 22 October 2016, and at times prior thereto, two fixed ladders were being used to access a basket platform on a Mi-Jack MJ50 mobile gantry crane in which the rungs were spaced in excess of 12 inches, exposing workers to a fall hazard of approximately 13 feet 9 inches to the ground below.

29 CFR 1910.27(c)(4): The employer did not install fixed ladders with at least 7 inches of clearance from the centerline of the rung to the nearest permanent object in the back of the ladder. On or about 22 October 2016, and at times prior thereto, two fixed ladders were being used to access a basket platform on a Mi-Jack MJ50 mobile gantry crane in which the clearance behind the two bottom rungs was less than 7 inches, exposing workers to a fall hazard of approximately 4 to 6 feet to the ground below.

On or about 22 October 2016, and at times prior thereto, three wire rope slings were in service on the Mi-Jack MJ50 mobile gantry crane without tags to indicate the slings rated load, angle or legs, exposing the workers to the hazard of being struck by a falling or swinging load.

29 CFR 1904.39(a)(2): The employer failed to report the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, within (24) twenty-four hours. On 22 October 2016, at approximately 7:15 AM, an accident occurred at a work site in which an employee suffered workplace injuries requiring in-patient hospitalization. The hospitalization was not reported to the Austin Area Office of the Occupational Safety and Health Administration within twenty-four (24) hours. Notification occurred on 27 October 2016 at approximately 9:58 AM.
