29 CFR 1910.134(c)(2)(ii): The employer must establish and implement those elements of a written respiratory protection program necessary to ensure that any employee using a respirator voluntarily is medically able to use that respirator, and that the respirator is cleaned, stored, and maintained so that its use does not present a health hazard to the user. International Container Co. LLC., 110 N Bridge St. Holyoke, MA 01040: On or about 11/3/2016, The employer provided elastomeric 3M Model 7503 Half-face respirators on a voluntary use basis to employees using the plasma cutter and the employer did not ensure that the employees were medically able to use the respirator, and that the respirators were cleaned, stored, and maintained so that the respirator did not present a health hazard to the user. On the day of the inspection, an employee operating the plasma cutter used a respirator with worn straps and dirty cartridges and cartridge covers.

29 CFR 1910.141(a)(4)(ii): All sweepings, solid or liquid wastes, refuse, and garbage shall be removed in such a manner as to avoid creating a menace to health and as often as necessary or appropriate to maintain the place of employment in a sanitary condition. International Container Co. LLC, 110 N Bridge Street, Holyoke, MA 01040: On or about 11/3/2016, employees were exposed to health hazards associated with unsanitary conditions in toilet facilities located on the back side of the building. The toilet facilities were observed to have piles of used toilet paper and paper towels on the floor and commodes, urinals and hand washing sinks were stained and were not clean.

29 CFR 1910.132(d)(1): The employer shall assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). If such hazards are present, or likely to be present, the employer shall: International Container Co. LLC, 110 N Bridge St. Holyoke, MA 01040: On or about 11/3/2016, the employer did not perform a hazard assessment for employees who work on the plasma-cutter to identify the proper PPE required to protect employees. Employees were required to wear hard hats, steel-toe boots, gloves, ear plugs, and safety glasses, and wear an elastomeric, half-face respirators on a voluntary-use basis.
