OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to fall hazards: a) On November 7, 2016, employees were exposed to a fall hazard while working inside an excavation approximately 12 feet in depth. Employees were using two foot by eight foot Symons concrete forms as a single ladder by leaning the forms against vertical rebar at the north end of the excavation. The employer did not ensure that the employees used appropriate equipment to work on the rebar.
