29 CFR 1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavation by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. On or about November 9. 2016, employees were working in an excavation which depth was greater than 5 feet and the spoilage was not placed at least 2 feet from the edge of the excavation. Employees were exposed to the hazard of a cave-in.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system: On or about November 9, 2016, employees were observed in a trench at a depth over 5 feet and they were not provided with any type of protection system. Employees were exposed to the hazard of cave-ins. NCT, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1000559, citation number 1, item number 2 and was affirmed as a final order on November 13, 2014, with respect to a workplace located at Tierra del Este, Unit 72,El Paso,TX, 79938.
