29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s)  a) Marine Operation Site, Point Reyes National Seashore, Drakes Estero: The employer failed to ensure that frequent and regular inspections of the job site was conducted. This continuing violation was most recently observed on November 8 and 9, 2016, when hazards including, but not limited to, walking across a ramp to and from barge to shore without guardrails installed to prevent fall to water, pressured treated lumber or old oyster racks with protruding nails, working over water without wearing U.S. Coast Guard-approved life jacket or buoyant work vests, and working in a cold water without wearing appropriate wet or dry suit suitable for the environment to prevent hypothermia or lowering abnormal low body temperature in water, which is part of the Pacific Ocean near the San Francisco Bay.

29 CFR 19261926.51(c)(3)(ii): Under temporary field conditions, provisions was not made to assure not less than one toilet facility is available such as chemical toilets working on a floating barge.     a) Marine Operation Site, Point Reyes National Seashore, Drakes Estero: The employer failed to provide an adequate toilet facility aboard a floating barge. Workers depart the land side around 6:45 a.m. and returned around 3:00 p.m., Monday thru Friday weather permitting.
