29 CFR 1910.23(c)(1):  Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toe boards:    (a) Stack-off Area - An employee working on top of the 90 degree stack-off conveyor was exposed to a fall hazard of approximately nine feet six inches. The employee was not protected by any guardrail systems and/or other fall protection devices, on or about November 10, 2016.    IN THE ALTERNATIVE    29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered:    (a) Stack-off Area - An employee working on top of the 90 degree stack-off conveyor was exposed to a fall hazard of approximately nine feet six inches. The employee was not protected by a personal fall arrest system (PFAS) and/or other fall protection device, on or about November 10, 2016.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.1200(h)(3)(ii): Employee training did not include the physical and health hazards of the chemicals in the work area:    (a) Deboning Department - Employees working adjacent to totes containing a mixture of ice and dry ice were not provided with training on the physical and health hazards of carbon dioxide caused by the sublimation of the dry ice, on or about December 20, 2016.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

He was working immediately adjacent to the disconnect and the other two employees working on the conveyor had locks on the disconnect, on or about November 10, 2016.   No abatement certification or documentation required.
