29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels were not protected by guardrail systems, safety net system, personal fall arrest system, or other approved alternative fall protection system: (a)Spring Creek Construction, Inc. at 3944 Fairway Hills Dr., Rapid City, SD 57702: On or prior to November 14, 2016, the exposing employer did not ensure that employees were protected from injury, in that approximately four employees erecting exterior walls on the third level worked near the unprotected edge without utilizing a fall protection system. This condition exposed the employees to a fall hazard of approximately 20 feet. (b)Spring Creek Construction, Inc. at 3944 Fairway Hills Dr., Rapid City, SD 57702: On or prior to November 14, 2016, the exposing employer did not ensure that employees were protected from injury, in that two employees staging material near the unprotected edge on the third level were not utilizing a fall protection system. This condition exposed the employees to a fall hazard of approximately 20 feet.

29 CFR 1926.503(b)(1): The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer: (a) Spring Creek Construction, Inc. at 3944 Fairway Hills Dr., Rapid City, SD 57702: On or before November 14, 2016, the employer did not ensure a written fall protection training certification record was prepared which included the identities of employees trained, dates of training, and the signature of the trainer or employer. Abatement Note: Paragraph (a) of this section requires that the employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas: (a) The nature of fall hazards in the work area; (b) The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used; (c) The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used; (d) The role of each employee in the safety monitoring system when this system is used; (e) The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs; (f) The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; and (g) The role of employees in fall protection plans; (h) The standards contained in this subpart.
