29 CFR 1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) Spring Creek Construction, Inc. at 3442 Jerusalem Boulevard, Rapid City, SD 57701: On or about and at times prior to December 22, 2020, the employer did not ensure that employees that were conducting framing operations on a residential property were provided with a fall protection system. This condition exposed employees to a fall hazard greater than six feet. The Spring Creek Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1191416, citation number 1, item number 1a, and was affirmed as a final order on December 20, 2016, with respect to a workplace located at 3944 Fairway Hills Drive, Rapid City, SD 57702.

29 CFR 1926.503(b)(1):The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. (a) Spring Creek Construction, Inc. at 3442 Jerusalem Boulevard, Rapid City, SD 57701: On or about and at times prior to December 22, 2020, the employer did not certify that employees were trained in fall protection. Spring Creek Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.503(b)(1), which was contained in OSHA inspection number 1191416, citation number 1, item number 1b, and was affirmed as a final order on December 20, 2016, with respect to a workplace located at 3944 Fairway Hills Drive, Rapid City, SD 57702. Abatement Note: Paragraph (a) of this section requires that the employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas: (a) The nature of fall hazards in the work area; (b) The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used; (c) The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used; (d) The role of each employee in the safety monitoring system when this system is used; (e) The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs; (f) The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; and (g) The role of employees in fall protection plans; (h) The standards contained in this subpart.
