29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. The controlling contractor is failing to ensure that all employees of the sub-contractor Masters Roofing exposed to eye and face hazards from flying particles while working on a residential roof. This most recently occurred on November 16, 2016 on the jobsite located at 4941 Concord Rd, Lincoln, NE 68516. Employees were observed using power tools while installing roofing material without any form of eye or face protection. They were using a battery operated hand saw and a pneumatic nail gun.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system. The controlling contractor is failing to ensure that all employees of the sub-contractor Masters Roofing exposed to fall hazards while working on a residential roof are utilizing fall protection. This most recently occurred on November 16, 2016 on the jobsite located at 4941 Concord Rd, Lincoln, NE 68516. Employees were observed reroofing the residence on a 10 in 12 steep sloped roof at heights of approximately 11.5 feet above the ground.
