29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets.    On or about November 16, 2016 and at times prior thereto, at the worksite located at 2795 West Cotton Willow Way, an employee was in the immediate vicinity of an employee above him who was framing the third story of an apartment building with a pneumatic nail gun and a hammer, exposed to struck by injuries to the head.

29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents.    On or about November 11, 2016 and times prior thereto, employees at the construction site located at 2795 West Cotton Willow Way were using pneumatic nail guns without eye protection while performing framing construction for a new apartment complex. This condition exposed employees to struck-by injuries to the eye.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).    On or about November 16, 2016 and at times prior thereto, at the worksite located at 2795 West Cotton Willow Way, employees were performing framing construction above the third floor of an apartment building without fall protection. This condition exposed employees to the hazard of falling to the ground below.

On or about November 11, 2016 and at times prior thereto, at the construction site located at 2795 West Cotton Willow Way were performing framing construction in the vicinity of wall openings on the third floor while performing framing construction without fall protection, exposed to the hazard of falling to the ground below.

On or about November 16, 2016 and at times prior thereto, at the worksite located at 2795 West Cotton Willow Way, an employee accessed the top of an 8 foot frame via a stepladder that did not extend at least 3 feet above the upper landing surface, exposing the employee to the hazard of falling to the deck below.
