29 CFR 1910.23(d)(2): The employer shall ensure that the minimum perpendicular distance from the centerline of the steps or rungs, or grab bars, or both, to the nearest permanent object in back of the ladder is seven inches: (a)CHS Eastern Famers @ 47017 SD Hwy 44, Worthing, SD 57077: On and prior to November 10, 2016, the employer did not ensure that a wooden fixed ladder located within the fertilizer building had a minimum of seven inches of clearance from the centerline of the rungs to the nearest permanent object. The rung distance to the concrete wall it was attached to measured at its shortest distance of 4 3/8ths inches to 6 inches. This condition exposed employees to fall hazards of up to 19'6".

29 CFR 1910.23(b)(2): The employer must ensure that ladder rungs, steps, and cleats are spaced not less than 10 inches and not more than 14 inches apart: (a)CHS Eastern Farmers @ 47017 SD Hwy 44, Worthing, SD 57077: On and prior to November 10th, 2016, the employer did not ensure that the distance between rungs did not exceed 12 inches. A fixed wooden ladder located within the fertilizer plant measured approximately 14.5 inches.
