29 CFR 1910.38(b): An emergency action plan was not in writing, kept in the workplace, and available to employees for review: a) 1 Technology Way, Salem, Ma 01970 On or about November 29, 2016, the employer did not have an adequate written emergency action plan kept available in the workplace for employees to review. The employer's written emergency action plan was not followed, and did not evacuate all employees from the facility from initial notice that chlorine had been released. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1904.19(d).

29 CFR 1910.120(q)(1): The employer did not develop and implement an emergency response plan to handle anticipated emergencies prior to commencement of emergency response operations: a) 1 Technology Way, Salem, MA 01970 On or about November 23, 2016, The employer did not develop an adequate emergency response plan in order to handle a chlorine release, allowing employees to stay within the building for approximately 2 hours after an initial alarm, instead waiting until a constant alarm to fully evacuate the building. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1904.19(d).
