OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to fall hazards:  a) This violation was observed on or about November 29, 2016, employees installing sheet metal siding on the structure were exposed to the hazard of falls while standing on the mid-rails of the Star Industries work platform.    b) This violation was observed on or about November 29, 2016, employees installing sheet metal siding on the structure were exposed to the hazard of falls while working from the Star Industries work platform which extended more than 10 inches past the wheel base of the forklift on both sides.

29 CFR 1926.451(c)(2)(v): The employer used forklifts  to support scaffold platforms without ensuring that the entire platform was attached to the fork and that the forklift was not moved horizontally while the platform was occupied:  Construction site, back of building: On or about November 29, 2016, employees were exposed to falls, when the scaffold platform was not secured to the forks of the Caterpillar forklift, while installing sheet metal siding.

29 CFR 1926.453(b)(2)(vi): Boom and basket load limits specified by the manufacturer were exceeded:   Construction site, back of building: On or about November 29, 2016, employees were exposed to falls, when the Genie S-45 aerial lift was occupied by three employees, while installing insulation board and sheet metal siding.

29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:  Construction site, back of building: On or about November 29, 2016, employees with no protective helmets  were exposed to struck-by hazards, when raising the sheet metal siding over their heads and to the scaffold platform and aerial lift, while installing sheet metal siding.   The United Erectors was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.100(a), which was contained in OSHA inspection number 283214,, citation number 001, item number 001 and was affirmed as a final order on 04/27/12, with respect to a workplace located at 5826 Hawk Springs, San Antonio, TX 78249.

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated:  Construction site, back of building: On or about November 29, 2016, employees not wearing safety harnesses were exposed to falls, when working from a Genie Aerial Lift Model S-45, while installing sheet metal siding.  The United Erectors was previously cited Repeat for a violation of this occupational safety and health standard or its equivalent standard 1926.453(b)(2)(v), which was contained in OSHA inspection number 283214, citation number 2, item number 1 and was affirmed as a final order on 04/27/12 , with respect to a workplace located at 5826 Hawk Springs, San Antonio, TX 78249.
