29 CFR 1910.23(c)(3): Regardless of height, open-sided floors, walkways, platforms, or runways above or adjacent to dangerous equipment, pickling or galvanizing tanks, degreasing units, and similar hazards shall be guarded with a standard railing and toe board. (a) In the dip tank area, employees were exposed to fall hazards when splashing wood preservative such as but not limited to: KOP-COAT, Inc. Woodtreat (R) MB RTU, Woodlife (R) F clear wood preservative water repellent, or Woodlife 111 water preservative over doors lowered into an unguarded dip tank.

Employee training shall include at least: The details of the hazard communication program developed by the employer, including an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employees can obtain and use the appropriate hazard information. (a) The employer did not provide hazard communication training to employees using chemicals such as but not limited to: Woodtreat (R) MB RTU, MEK, and lacquer thinner. The training did not include details such as but not limited to: the hazard communication program, labeling systems, information on the safety data sheets.
