OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to an fall hazard: a) In the warehouse, on or about 11/27/2016, an employee fell 25 feet when he was lifted inside the basket and the basket hit the bottom of the top of the storage rack causing the basket to slide off of the pallet. The employee sustained serious injuries and he was hospitalized. The SALA fork-lift basket, model no. 8510568 S/N 137433, was not secure to the RC 5500 Crown forklift with a chain or other method, and the forks were not inserted into the bottom of the basket.
