29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (a) Production area- The employer had not established or implemented a hazard communication program to include a written program, maintaining safety data sheets, and training. Employees were exposed to hazardous substances such as, but not limited to, dust containing silica, lacquer thinner, and Stand Off Limestone and Marble Protector, containing mineral spirits, isobutyl triethoxysilane, and ethyl silicate.

29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program: (a) Production areas including the rail/bridge saw, edging, polishing, sanding, and sink hole cutting areas- On or about December 8, 2016, and times prior, the employer exposed employees cutting, edging, polishing, and sanding marble and granite countertops to noise levels ranging from 91.9 to 94.9 decibels. The employer had not conducted personal noise monitoring to identify employees exposed to noise exceeding the 8-hour time weighted average of 85 decibels.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: (a) Sink hole cutting area- The employer had not established or fully implemented a respiratory protection program for employees required to wear half mask air purifying type respirators while dry cutting sink holes for marble and granite countertops. There was no written program, medical evaluations, fit-testing, training, or proper selection and cleaning.
