29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    (a) Dry Room-  The employer exposed employees to noise hazards, in that the employer failed to implement a hearing conservation program for an employee grinding and cutting sink holes in marble countertops was exposed to continuous noise at 82.24 % of the permissible daily exposure of 85 dBA (time weighted average) or an equivalent sound level of 88.5 dBA during the 469 minute sampling period on October 26, 2017. The exposure calculation included a zero increment for the 11 minutes not sampled.

29 CFR 1910.1000(c): The employer did not ensure that an employee's exposure to any substance listed in Table Z-3 in any 8-hour work shift did not exceed the 8-hour time weighted average(TWA) limit given for that substance in the table.    a)Dry Area - The employer exposed an employee to respiratory hazards, in that an employee using portable hand held tools to grind edges and cut sink holes dry in marble/granite countertops was exposed to respirable silica (quartz) at an 8-hour TWA of  2.3 mg/m3.  This level exceeded the permissible exposure level (PEL) of 0.345 mg/m3 by 6.8 times.  The exposure was derived from a sample collected over a 170 minute sampling period on October 26, 2017. Exposure calculations included a zero increment for the minutes not sampled.
