OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls in excess of nine feet from an elevated buggy: On or about December 5, 2016 and times prior to, at the above addressed jobsite, employees working from an elevated buggy were exposed to a fall hazard of approximately 9 feet.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards: On or about December 5, 2016 and times prior to, at the above addressed jobsite, employees working from an elevated buggy were exposed to a fall hazard and were not trained on the hazards of working from the buggy.
