29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: On December 12, 2016, at the above addressed job site, employees were exposed to heavy equipment struck-by hazards due to the employer not instructing all employees that cell phones were prohibited from use while performing construction work activities such as walking and working in close proximity to moving equipment.
