29 CFR 1910.212(a)(1):     One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:    On December 12, 2016, at 138 North Broad St., Fremont, Nebraska, the employer failed to ensure that the access plate (guard) that the employer supplied and installed on the Crown Cascade Conditioner CCC Cyclone was maintained on the equipment, resulting in an employee being able to access the rotating cyclone blades.

29 CFR 1910.272(m)(2):    The employer failed to promptly correct dust collection systems which were malfunctioning or which were operating below designed efficiency.    On December 12, 2016, at 130 N. Broad St., Fremont, Nebraska, the employer failed to minimize accumulations of fugitive dust in the motor control center and adjacent mechanical rooms of the rail loadout building. The door to the motor control center had been left open, and no pressurized environment was maintained in the motor control center. The adjacent mechanical rooms were  not designed to be enclosed from the rail loadout area, and had open passageways, walls, and space for machinery to run.

29 CFR 1910.22(d)(1): On every building or other structure, or part thereof, used for mercantile, business, industrial or storage purposes, the loads approved by the building official were not marked on plates of approved design and securely affixed in a conspicuous place in each space to which they relate.    The employer is failing to ensure that the weight capacity above the storage area is clearly marked in accordance with this subpart.  This was most recently documented on December 12, 2017 at 130 North Broad St. Fremont, Nebraska.  The employer failed to mark the capacity of the area above the pipe fitting room with its capacity when using it to store metal pipes and other items.
