29 CFR 1910.95(g)(1): The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels:    Audiometric testing was not conducted for employees with the following exposures:    a) Auto picket Area: An employee that was stacking Aluminum fence pieces was exposed to continuous noise levels in excess of the allowable 8 hour time-weighted average sound level (PEL). The employee's dosimeter dBA level was 140.2% of the permissible level (90 dBA) and was equivalent to approximately 92.4 dBA. The sampling was performed for 440 minutes during one 8 hr. shift on 2/1/16. Zero exposure was assumed for the unsampled period of time.    b) Auto picket Area: An employee that was operating the Auto Picket and removing Aluminum bars pieces was exposed to continuous noise levels in excess of the allowable 8 hour time-weighted average sound level (action level). The employee's dosimeter dBA level was 85.21% of the permissible level (90 dBA) and was equivalent to approximately 88.8 dBA. The sampling was performed for 426 minutes during one 8 hr. shift on 2/1/16. Zero exposure was assumed for the unsampled period of time.    c) Paint Line: An employee that was adding and removing Aluminum bars from the paint line was exposed to continuous noise levels in excess of the allowable 8 hour time-weighted average sound level (action level). The employee's dosimeter dBA level was 90.72% of the permissible level (90 dBA) and was equivalent to approximately 89.2 dBA. The sampling was performed for 428 minutes during one 8 hr. shift on 2/1/16. Zero exposure was assumed for the unsampled period of time.    d) Picket Drill Area: An employee that was operating the drill machine was exposed to continuous noise levels in excess of the allowable 8 hour time-weighted average sound level (PEL). The employee's dosimeter dBA level was 124.2% of the permissible level (90 dBA) and was equivalent to approximately 91.5 dBA. The sampling was performed for 436 minutes during one 8 hr. shift on 2/1/16. Zero exposure was assumed for the unsampled period of time.     NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1910.212(a)(3)(ii): Point(s) of operation of machinery were not guarded to prevent employee(s) from having any part of their body in the danger zone(s) during operating cycle(s):    a) Fabrication Area: Employees use the vinyl router to cut holes into PVC fence pieces and the machine was not designed to prevent an employee from putting their hand or body part in the danger zone during the operation cycle., on or about 1/26/16.     NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
